Why should employers screen applicants
with the resources at i-Background.com?
Employment screening is a proven,
effective method that assists employers
in reducing workplace violence, employee
theft, drug abuse, and dependability issues.
It's a valuable tool that helps protect
employees and provides a safe workplace.
Pre-Employment
Background screening also
improves productivity levels and decreases
employee
turnover.
Additionally, it helps avoid negligent
hiring and retention litigation.
Today there is a heightened awareness by
many business owners and human resources
and security professionals regarding the
need to truly know whom they are hiring
- and with good reason. The consequences
of bringing the wrong person into an organization
can be devastating. Fortunately, using I-Background.com
you can ensure you're making hiring decisions
that improve your company rather than place
it in danger.

Do
you need to have the Social Security numbers
of the people you want to investigate or
is it possible to search with just the
persons
name and address?
No, in most cases when searching
court records, public records, etc. you
only
need a name to do searches. Sometimes just
a last name will get you started. Of course,
the more information you have the better
your chances are going to be for success.

Do
Federal, State and County Courts handle
different types of criminal offenses?
When conducting Criminal Background Checks it is important to know the difference between each type of court. Federal Courts handle crimes that
violate Federal laws, such as bank robbery,
counterfeiting, auto theft, using the mail
to defraud, federal narcotics violations,
interstate commerce, crimes committed across
state lines, etc. Federal District Court
searches are available by retrieval service
only.
State Courts handle crimes based on state
laws, constitutions of the individual state.
These laws are enacted by the individual
state legislatures. Each state is independent
and unique. SOME states, but NOT ALL, have
statewide court systems with online access.
In states that do not have statewide systems,
criminal cases are handled at the county
level.
Both of these searches involve criminal records, but the source of information and the focus of each search is very different.
While
it is possible for both products
to yield the same case information
on a subject, your chances
of finding information will
be greater if you follow these
simple guidelines:
If you know or think a subject was tried for a criminal offense in a particular
county, choose county criminal
search. This is where the actual
records filed in that county
are hand-checked by a qualified
court records researcher.
If you know or think a subject was tried for a criminal offense in a particular
state, but don't know the county,
or if the subject has moved
around a state several times,
try a statewide criminal Search.
This search has a much wider
geographical focus.
Not all counties are required to report to the state, therefore statewide information
may not be available in states
such as AK, CA, DE, NV, NY,
SD and WV.
In
explanation, when a person
is convicted, their trial goes
through the county. This information
can either be passed on to
the state or left in the county.
Therefore, if you know the
county the individual is convicted,
your chances of finding information
is greater than doing a statewide
search.

Can
I obtain someone's Social Security number
using your service?
The
answer is probably not. Unless you are in
law enforcement, or otherwise qualified
to obtain a person's SS number, that information
is simply unattainable by the average person
and there is a good reason for that. If
someone can get your SS number then they
could also be well on the way to stealing
your entire identity if they were so inclined.
If everyone could obtain Social Security
numbers then just imagine what a huge problem
identity theft would be. However, our service
does link you to Social Security checks.
With this tool you can check a SS number
and see if it is valid, whether the owner
is alive or dead, where and when it was
issued and so forth. [

What is a Corrections Record? Each
criminal charge is handled at the appropriate
court level, dependant on jurisdiction.
If a person is convicted of a more serious
crime at the state level, it will be forwarded
to the State Department of Corrections for
supervision. This typically includes felony
and higher level misdemeanor convictions.
However, each state determines its own procedures.
Departments of Corrections Records contain
only conviction information and are typically
statewide searches. The benefit is most
DOC records go back at least 10 years. We
provide links to all 50 States DOC databases.
We also provide contact information for
the DOC. Not all states consider these records
public. Federal criminal convictions are
handled by the Federal Bureau of Prisons.

What is the difference between a federal
court records search and a state court records
search?
Federal Courts handle crimes that violate
Federal laws, such as bank robbery, counterfeiting,
stealing cars and driving them over a state
line, using the mail to defraud, federal
narcotics violations, interstate commerce,
crimes committed across state lines, etc.
If an individual violates a Federal law,
only Federal courts will have jurisdiction
over the matter and only Federal courts
will have a record of the case. Federal
District Court searches are available by
retrieval service only.

Civil Court matters represent disagreements
between two parties - the plaintiff and
the defendant. It can be money, non-performance
of a contract, divorce, estate, real estate
matters, etc. Criminal matters represent
a charge by an enforcing agency against
an individual who is suspected of committing
a crime against person(s) or property. Crimes
are defined by individual state, municipal,
or federal law.

What can I do if I have questions about
FCRA compliance? Our Customer
Support team recommends searching Google
on FCRA-compliance and is ready to answer
any questions you may have regarding how
to comply with the Fair Credit Reporting
Act. We abide by the FCRA (Fair Credit Reporting Act) limitations in the information that we report. According to the FCRA, all outsource criminal reporting agencies have a limit of seven years. If you would like to go further in your search, you would have to call the county courthouse in the county the crime was committed to learn of their procedures for obtaining older information.
